Alina Habba was Donald Trump’s personal attorney. Trump wanted her to become the “chief prosecutor” (meaning the person who represents the government in criminal cases) in the state of New Jersey.

Normally, to get this position, the Senate has to say “yes.” But the Senate didn’t want to.


So, Trump and his team tried to bypass the rules by using several complicated maneuvers to keep her in that role without the Senate’s approval. People who were accused of crimes said: “That’s not fair, she wasn’t properly appointed!” They filed lawsuits.

A judge had already ruled this summer that she had no right to hold that position. Trump appealed!

And today, a higher court (the Court of Appeals) confirmed: she was not allowed to occupy that post. The judges explained that if this system were accepted, anyone could become a prosecutor without following the legal rules.


In short: the judges said “no” to Trump and Alina Habba because they tried to circumvent the rules to appoint her as chief prosecutor without the Senate’s consent.
